Limitation Of Liability

Clause 16

To the fullest extent allowed by applicable law, under no circumstances, legal theory, or cause of action (including, without limitation, breach of contract, breach of warranty, and/or tort) shall social comment or our affiliates, licensors, or suppliers be liable to you, any person or entity claiming through or under you, or any other person or entity for any lost revenue, lost profits, lost business, or any indirect, incidental, consequential, or special damages (even if we have been advised of the possibility of such damages) arising from or relating to these terms or your access and/or use of the platform and in particular and without limitation arising from or relating to:

(a) any errors, mistakes, or inaccuracies in any user content posted on the platform or any other content or communications on the platform;

(b) personal injury or property damage of any nature whatsoever resulting from your access and/or use of the platform;

(c) any unauthorized access to our servers and/or any loss of any personal data and/or financial information stored therein;

(d) any interruption or cessation of transmission to or from the platform;

(e) any viruses, bugs, malware, trojan horses, worms, or other unauthorized and/or unwanted computer programs which are transmitted to or from the platform; and/or

(f) any loss or damage of any kind (including, without limitation, any financial, reputational, and/or emotional shock and/or damage) incurred as a result of the access and/or use of the platform (including, without limitation, due to the unauthorized use of your account by any third-party) or because of any user content posted on the platform or any other content or communications on the platform.

Notwitshstanding anything to the contrary mentioned in the preceding sub-clause or the rest of these terms, our aggregate liability under these terms to you or any person or entity claiming under or through you shall not exceed Indian national rupees (INR) ______ if you have a free account and INR _____ if you have a premium account.
