Termination
Clause 11
We may terminate your account on the Platform if:
We learn that you are below eighteen (18) years of age;
We learn that you have given false information regarding your identity at the time of creating your account or that you are impersonating another person;
Your country of residence has a higher legal age of majority than eighteen (18) years or if you must attain a higher age than eighteen (18) years in order to be considered as an adult due to any special circumstances and we learn that you have not attained such higher age;
You do not log into your account for a period of seven (7) years and we do not receive any communication from your nominee or legal heir under clause 9 of these Terms;
Your nominee or legal heir fails to complete any of the procedures or submit any of the documents required under clause within a period of six (6) months from your death;
You fail to reply to us with your explanations/reasons under clause 5.4.1 of these Terms within the period of seven (7) days;
We do not find your explanations/reasons under clause 5.4.1 to be convincing;
You post any Prohibited Content during the period of ninety (90) days that your account is being monitored under clause 5.4.2 of these Terms;
You repeatedly violate any of the provisions of these Terms or any other Policies, Programs, and/or Agreements on the Platform;
You act in a manner which disrupts our business operations or which is likely to result in legal claims against us;
You threaten or harass other users on the Platform; or
You act in a manner which can objectively be regarded as inappropriate or unlawful according to the laws in force in India.
In addition, we reserve the right to terminate your account for any or no reason and without following the procedure mentioned in the succeeding sub-clauses.
If we decide to terminate your account, we shall send you a show-cause notice informing you of our decision and our reasons for the same. You shall have five (5) days from the date of receipt of our notice to respond to the notice and provide reasons for why your account should not be terminated. If you respond to our notice within five (5) days, we shall evaluate your response and reach a final and non-appealable decision within seven (7) days of receiving your response.
We shall freeze your account in accordance with clause 4.4 of these Terms from the time we send you a show cause notice under the preceding sub-clause till the time we reach a final decision on whether to terminate your account.
If you fail to respond to our notice of termination as per clause 11.2 within five (5) days, or if we decide to terminate your account even after receiving your reply, we shall send you a notice informing you of the termination of your account and your account shall stand terminated from the time you receive such notice.
Notwithstanding anything contained in the preceding sub-clauses, if we decide to terminate your account under clauses 11.1(a), 11.1(c), 11.1(d), 11.1(e), 11.1(f), 11.1(g), or 11.1(h), we may terminate your account without following the procedure mentioned in the preceding sub-clauses.
Upon the termination of your account, all the rights and/or obligations of you and Social Comment under these Terms will be extinguished, except for the rights, obligations, and/or provisions mentioned in clause 23.5.
If your account is terminated, we shall determine, at our sole discretion, the portion (if any) of the balance in your Wallet at the time of termination that you will receive after the termination of your account. The portion so determined by us, if any, shall be transferred to the bank account/UPI ID linked with your Wallet within sixty (60) days of the termination of your account. If we decide to forfeit any or all of the balance in your Wallet at the time of termination, you agree and understand that neither you, your nominee, your legal heir, or any other person/entity shall have any right, claim, or interest over the balance/amount so forfeited.
